A 90-year-old woman has been evicted from her special care home in Hampton and her family is now calling on the provincial government to redraft its eviction policy.
Louise Leaman has lived at the Clearview Seniors Home for about four years.
But her son, Wayne Leaman, was told last week that the home would no longer be able to accommodate her because she was uncooperative and difficult to get along with.
The reasons given don't sit well with him, he said.
"If the person is a danger to herself, or threatening other people, or trying to hurt other people, that might be a valid reason to look at," said Leaman, noting that his mother does have difficulty hearing and is recovering from eye surgery, making it difficult for her to see as well.
The family has managed to find another home in town willing to take her, but wants the provincial government to reconsider its special care home eviction policy.
"Special-care homes are exactly that description — you should be obtaining special care," said Leaman.
"When you're 90 years old, I don't think it's right in any way to be given 30 days notice to simply be put out of the home."
A spokesperson for the Department of Social Development described eviction as a last resort.
Normally, the provincial government will mediate disputes between owners and residents, but ultimately the decision to evict a resident lies with the special care home, the spokesperson said.
Cecile Cassista, of the Coalition for Seniors and Nursing Home Residents' Rights, said the current policy is unacceptable.
"If you want to look after seniors, then you have to go with the flow and make sure, because everybody has different moods and different habits, and you gotta work with them," she said.
The provincial government is looking at requiring homes to show "just cause" when explaining an eviction to a family.
The owner of Clearview Seniors Home declined to comment.
